Block Sues Intuit: Pros Not Plumbers

block logoThree units of H&R Block have filed suit in Missouri federal court alleging that Intuit's TurboTax advertisements infringe on the tax services company's  trademark and create a misleading impression of Block's services. The suit was brought by H&R Block Eastern Services Inc., HRB Innovations Inc. and H&R Block Enterprises LLC.


Intuit's television ads claim that Block's advertisements for preparer jobs for tax season say applicants do not have to be experienced. The TV ads show individuals realizing that a plumber or a retail sales person that they had just met had prepared their tax returns.

Intuit issued the following statement about the suit:  "While we do not comment on pending litigation, we do stand behind our advertisements and the statements made in those ads. We believe U.S. taxpayers should understand the differences between TurboTax and the major tax stores so they can make an informed choice for their tax preparation."

Intuit has also been prominently showcasing the availability of tax professionals such as CPAs and Enrolled Agents for those who prepare returns via its TurboTax software package. This is the second season that professional advice has been available to Intuit's consumer software users. Block's view has been that Intuit is adding professional advice because the do-it-yourself software approach has limits which are hindering Intuit's growth.
