I applaud the vendors who are providing this valuable service to help with sales and use tax issues. I also agree that most accountants have their heads in the sand when it comes to sales and use tax compliance. Sales and use tax laws across this country are very straightforward for simple transactions in the jurisdiction that one has nexus, but any other kind of transaction falls under the "god help me find the answer because there seems to be nothing written about this issue" approach if you are the client or helping the client. These transactions for the government are easy - if it is not specifically excluded or exempted, it is taxable. Some jurisdictions are better than others with guidance to help you through this, but most are not. So the states win these cases more often than not. The real problem is that the sales, use, and other taxes like these i.e. amusement, are broken in today's economy. And, the states are trying to "fix" this in the wrong way. It will be a sad day for all of us if the states get their way as there are serious constitutional issues with what they are trying to do. Use taxes have been unenforceable for the most part and the states have done nothing to fix this. Every citizen of a particular state is guilty of breaking this law. The businesses in a state are much better Use tax citizens. But it is these businesses that are going to pay the price for all the nonsense the states are proposing. Where are the accountant voices?
