CPA Gets Term in Client Fraud

Marc Howard Berger, CPAA California CPA has been sentenced to eight months in prison for helping client avoid $4.7 million in taxes. Marc Howard Berger, 68, of Walnut Creek, Calif., drew the sentence for aiding and assisting in the filing of false tax returns.

Berger was found guilty of preparing three fraudulent 1040 returns for Steven Burrill for the 2011, 2012, and 2013 tax years. Then a partner with Burr Pilger Mayer, Berger aided Burrell, owner and CEO of Burrill & Company, Burrill Capital, and related entities, hide more than $18 million in income.

Between December. 2007 and September 2013, Burrill transferred the money from managed venture capital funds to his management companies, a sum in excess of the management fees that were due and allowable under the agreements that governed the Fund.
