NOLA Preparer Gets 36-Month Sentence

A former tax preparer in New Orleans, LA., has been sentenced to 36 months in prison for stealing refunds intended for others. The former preparer, Donald Stewart, 60, had previously pleaded guilty to one count of theft of public funds and one count of aggravated identity theft involved in his receiving $539,393 in federal income tax refunds intended for others.

Stewart operated under the business Stewart's Tax Service and Stewart LTD, from about 2001 through 2008 until the Internal Revenue Service suspended his Electronic Filing Information Number. Then, from January 2011 through February Stewart had tax refunds intended for others deposited into bank accounts under his control.

Stewart must also serve one year of supervised release and ordered to pay restitution in the amount of $577,202.97 to the IRS.
