I passed the Registered Tax Return Preparer (RTRP) exam on January 8, 2013, and a week or so latter, a Court in Washington, DC ruled that the IRS has no legal authority to ask paid tax return preparers to take such a exam. Personally, I think that the IRS Lawyer did not make a good case as to the reasons every paid tax return preparer should take the exam. Because of many changes in the Tax Laws every year, it is necessary and important that tax preparers learn those new changes as to serve their clients better. Besides that, this exam added values to those preparers who are not CPAs, Lawyers or Enrolled Agents. The exam made tax preparation profession more respectable, and it is the best thing IRS has done since the history of that Agency. If those in the Health Industry like RN, LVN, CNA and Physical Therapists are made to take professional exams,register and obtain a license in their professions before they can practice, I don't see anything wrong for tax preparers to do the same and get acquainted, learn the new changes in the tax laws before getting eligibility to prepare people's income tax. I support that IRS should appeal this ruling fast before this Judge rubbish tax profession.
