IRS Wants to Bar Former LBS Preparers

dosThree Florida siblings tax preparers are targets of government effort to block them from operating tax businesses and to disgorge ill-gotten fees. The three are siblings of Walner Gachette, who operated Loan Buy Sell, a franchised chain that the Department of Justice succeeded in shutting down in 2014.

Each of the three worked at LBS stores and moved on to other tax businesses. At one time, LBS had 263 tax stores, which operated primarily in the south.

The recent action seeks to close the businesses operated by Herve, Gerline and St. Fonie Erilus. One complaint was filed against Herve Erilus of Cocoa, Fla., and his business, Herve Erilus LLC; one against Gerline Erilus of Orlando, Fla., and businesses, Gerline Erilus LLC and Elite Multi-Services LLC; and one against St. Fonie Erilus of Apopka, Fla. and her businesses, St. Fonie Erilus LLC and The Diversified Finance Solutions LLC.

The government alleges and their businesses charged exorbitant and often undisclosed fees. They utilized a variety of means to hike client refunds including falsely claiming the Earned Income Tax Credit; using improper filing status; fabricating businesses and related business income and expenses and deductions.
