The suit says Andrew went to work for his brother and learned fraudulent practices there. The IRS had previously suspended Larry Heath's electronic filing identification number because of the large number of erroneous returns he prepared. He is accused of selling his business to two different individuals and then using their EFINs to file returns.
U.S. Seeks to Bar Brother Tax Preparers
The Department of Justice has asked a federal court in Atlanta to prohibit two brothers from preparing federal tax returns for others. The department seeks an injunction against Larry J. Heath and his brother Andrew R. Heath, who operate separate businesses, saying the two may have cost the United States more than $100 million.
Larry J. Heath operates Heath's Income Tax II in Cartersville, Ga., and his Andrew R. Heath, runs Excellent Tax Service of Acworth, Ga. The two are accused of claiming a wide range of bogus deductions, expenses and credits for their clients. The court action says the Internal Revenue Service had to make adjustments to 94.5 percent of returns filed by the brothers.
